These terms apply to all users, including visitors, registered users, and any other individuals who access or use our AI-powered web application generation platform.

2. Service Description

LayerWise provides an AI-powered platform for generating web applications. Our service allows you to create, preview, and deploy web applications through natural language prompts processed by artificial intelligence. The service includes features such as real-time preview, team collaboration, project management, and deployment capabilities.

3. User Accounts

3.1 Account Creation

To use LayerWise, you must create an account by providing accurate and complete information. You may register using email authentication or through third-party OAuth providers (Google, GitHub). You are responsible for maintaining the security of your account credentials.

3.2 Account Responsibilities

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breaches. You may not share your account credentials with others or allow others to access your account.

3.3 Age Requirements

You must be at least 13 years old to use LayerWise. If you are under 18, you represent that you have your parent or guardian's permission to use the service.

4. Acceptable Use Policy

You agree not to:

Use the service for any illegal purpose or in violation of any laws
Attempt to reverse engineer, decompile, or extract our AI systems or algorithms
Interfere with or disrupt the service or servers or networks connected to the service
Attempt to gain unauthorized access to any part of the service or related systems
Upload or transmit viruses, malware, or any malicious code
Harass, abuse, or harm other users of the service
Generate content that is illegal, harmful, threatening, abusive, or hateful
Violate any intellectual property rights of others
Use automated systems to access the service without our prior written permission
Resell or redistribute the service without authorization

5. Intellectual Property

5.1 Our Intellectual Property

LayerWise and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform without explicit permission.

5.2 Your Content

You retain all rights to the content you create using LayerWise, including the web applications you generate. By using our service, you grant us a limited, worldwide, non-exclusive license to host, store, and process your content as necessary to provide the service. We may use anonymized, aggregated data derived from your usage to improve our AI models and service.

5.3 AI-Generated Content

Content generated by our AI systems is provided to you under these terms. While you have rights to use the generated content, you acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions. You are responsible for ensuring that any deployed applications comply with all applicable laws.

6. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee that LayerWise will be available at all times. We reserve the right to:

Modify, suspend, or discontinue any part of the service at any time
Impose limits on certain features or restrict access to parts of the service
Perform maintenance that may temporarily interrupt service availability

We will make reasonable efforts to notify you of significant changes or extended outages, but we are not liable for any unavailability of the service.

7. Payment and Billing

7.1 Pricing

LayerWise offers both free and paid subscription plans. Pricing details are available on our website and may be updated from time to time. We will provide notice of price changes for existing subscriptions.

7.2 Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). By subscribing, you authorize us to charge your payment method on a recurring basis. Subscriptions automatically renew unless canceled before the renewal date.

7.3 Refunds

We offer refunds on a case-by-case basis at our sole discretion. Generally, refunds are not provided for partial subscription periods. Contact our support team to discuss refund requests.

8. Termination

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms of Service
Violation of our Acceptable Use Policy
Engagement in fraudulent or illegal activities
Attempting to compromise the security of our platform
Non-payment of fees for paid services

Upon termination, your right to use the service will immediately cease. You may cancel your account at any time through your account settings. We will retain your data as described in our Privacy Policy.

9. Disclaimer of Warranties

LAYERWISE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
That the service will be uninterrupted, secure, or error-free
That any errors or defects will be corrected
That the AI-generated content will be accurate, complete, or suitable for your purposes

You acknowledge that AI systems can produce unexpected or incorrect results. You are responsible for reviewing and testing all generated code before deployment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAYERWISE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 IF YOU HAVE NOT MADE ANY PAYMENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless LayerWise and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to: (a) your use of the service, (b) your violation of these Terms of Service, (c) your violation of any rights of another party, or (d) content you create or deploy using our service.

12. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which LayerWise operates, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property disputes or violations of the Acceptable Use Policy.

13. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by email or through the service. Your continued use of LayerWise after such changes constitutes your acceptance of the new terms. If you do not agree to the modified terms, you should discontinue your use of the service.

14. Severability and Entire Agreement

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and LayerWise regarding the use of our service.
